The role of the guardian ad litem is to represent the best interest of the children. In determining the best interest of the children, the guardian ad litem may interview or observe the child, parents, teachers, and anyone who plays an important role in the children’s lives. The guardian ad litem then makes a recommendation to the court regarding custody and placement. The court holds the guardian ad litem’s recommendation in very high regard.

How to Prepare

Since the guardian ad litem’s recommendation plays such a large role in the court’s decision, it is very important to take it seriously and be prepared. Here are a few pointers for when you are talking to the guardian ad litem.

  • Speak about the facts, do not spend your time bad-mouthing your ex
  • Know your strengths and weaknesses as a parent
  • Know your child’s daily routine
  • Discuss family members that play an important role in the child’s life
  • Provide a list of people who can attest to your role as a parent

Every Guardian Ad Litem’s process is different, but the end goal is the same. They are looking out for the best interest of the children. Make sure what you are proposing is also what is best for the children, not just what is best for you.
