Avoid or Reduce Criminal Charges in Wisconsin

Criminal charges stand to jeopardize your freedom and your future. In the State of Wisconsin many counties offer different treatment alternatives and diversion programs (TAD). The two most common programs are Diversion and Deferred Prosecution Agreements and there is a significant difference between them.


DIVERSION PROGRAM

A pre-charge diversion occurs after you are arrested but before criminal charges are issued. You will not have to go through the court system and, if you successfully complete the terms of your agreement, you can avoid criminal charges on your record. As part of the agreement you must complete all requirements such as random drug and alcohol testing, drug treatment, anger management, community service, and pay any fines or restitution. If you are able to stay out of trouble and complete the terms of your agreement, no charges will be filed. If you are unsuccessful at meeting all the terms of your agreement, criminal charges can be filed and your case will continue through the Wisconsin court system.

DEFERRED PROSECUTION

A deferred prosecution agreement (DPA) is similar to the diversion except it occurs after charges have been filed. To enter into a DPA you must plead guilty to one or more of the criminal charges against you. However, the court will withhold entry of the judgment of conviction in order for you to complete the terms of the DPA. Similar to the pre-charge diversion program, you must complete all requirements of your agreement. If you are successful at completing all conditions of your DPA, the charges are often reduced or dismissed all together. If you are unsuccessful at completing your DPA, since you already plead guilty, the court will enter the judgment of conviction and your case will proceed to sentencing.
